Terms of Use

Effective date: August 31, 2026

Last updated: N/A

1. About these Terms

Lumina is a patient platform operated by Acacia Clinics ([legal entity: Zoe Healthcare, Inc.]) ("Acacia," "we," "us"). Lumina lets you complete check-in questionnaires, read educational material about your care, and share information with your care team between visits.

These Terms of Use ("Terms") are an agreement between you and Acacia. By creating an account or using Lumina, you agree to them. If you do not agree, please do not use Lumina — you can complete the same questionnaires on paper at the clinic, and your care will not be affected.

Please read Section 4 carefully. It explains what Lumina is not.

2. Who may use Lumina

You may use Lumina if you are a current patient of Acacia Clinics or an authorized representative of a patient.

If you are 18 years of age or older, please review the Terms of Service and sign at the bottom to confirm your agreement.  By signing, you also confirm that you are at least 18 years of age.

Patients under 18:  If you are under 18 years of age, please have your parent or legal guardian review the Terms of Service and sign below on your behalf.  By signing, your parent or legal guardian confirms that they have the legal authority to act on your behalf and agree to these Terms of Service on your behalf.

Once the account is set up, questionnaires about mood and symptoms are answered by the patient themselves. Those responses go to the patient's Acacia care team. They are not shown in a parent or guardian view.

A guardian can see appointments, treatment schedule, and whether a check-in has been completed. Anything the care team believes a guardian needs to know will be discussed directly, not through this platform.

If a patient is old enough under California law to consent to their own mental health care, their rights over their records are unchanged by these Terms.

Authorized representatives. If you are using Lumina on behalf of a patient — as a parent, guardian, conservator, or holder of a health care power of attorney — you confirm that you have legal authority to do so, and you agree to these Terms on the patient's behalf and your own. We may ask for documentation of your authority and may suspend access if we cannot verify it.

3. Lumina and your care

Lumina supports your care at Acacia. It does not replace it.

Information you enter becomes part of the record your care team uses to make decisions with you. Please answer accurately and completely — including when the honest answer is difficult. Incomplete or inaccurate information can affect the care you receive.

Using Lumina does not create a clinician-patient relationship on its own, and it does not change the terms of the care you receive at Acacia.

4. Emergency and urgent situations

Lumina is not monitored around the clock and is not an emergency service.

Responses and messages submitted through Lumina are reviewed during clinic hours, [Monday–Friday, 8:00am–5:00pm Pacific], excluding holidays. Submitting information through Lumina does not guarantee that a member of your care team will see it before your next scheduled visit.

Do not use Lumina to report a medical emergency, a change in your condition that needs immediate attention, or thoughts of harming yourself or someone else.

In those situations:

  • Call 911, or go to your nearest emergency room

  • Call or text 988 — the Suicide & Crisis Lifeline, available 24 hours a day

  • Text HOME to 741741 — Crisis Text Line

  • Call Acacia Clinics at [phone] during clinic hours

By using Lumina, you acknowledge that you understand these limits.

5. Educational content

Educational material in Lumina is provided for general information. It is not medical advice and does not account for your individual history, diagnosis, or circumstances.

Never start, stop, or change a treatment or medication based on something you read in Lumina. Talk with your Acacia clinician first.

We work to keep this material accurate and current, but medicine changes, and we do not warrant that every statement reflects the most recent evidence at the moment you read it.

6. Your account

You are responsible for keeping your login credentials confidential and for activity that occurs under your account. Do not share your password or let another person use your account, even someone you trust — information about your mental health care is unusually sensitive, and shared access removes our ability to protect it.

Tell us promptly at (650) 521-5211 or [email protected] if you believe your account has been accessed by someone else.

We may suspend or close an account to protect patient safety, to protect the security of the platform, or if these Terms are violated.

7. Acceptable use

When using Lumina, you agree not to:

  • Access or attempt to access another person's health information

  • Share, publish, or distribute another patient's information encountered through any error or malfunction — please report it to us instead

  • Submit content that is unlawful, threatening, harassing, or abusive toward staff or others

  • Interfere with, probe, or attempt to disrupt the security or operation of the platform

  • Use automated tools to access, scrape, or extract data from Lumina

  • Misrepresent your identity or your authority to act for another person

8. Communications

If you provide a mobile number or email address, we may send you appointment reminders, questionnaire prompts, and messages related to your care.

Message frequency varies. Message and data rates may apply. You can stop text messages by replying STOP, and stop most emails using the unsubscribe link. Some communications directly related to your treatment may continue by other means, because we may still need to reach you about your care.

Text messages and email are not fully secure. Anyone with access to your device or email account may be able to read them. Tell us if you would prefer we not use these channels.

9. Privacy and health information

Health information in Lumina is protected health information under HIPAA and California law. Our handling of it is described in the Acacia Clinics Notice of Privacy Practices, available at [URL] and at the clinic. Where these Terms and the Notice of Privacy Practices differ regarding health information, the Notice governs.

We use service providers to operate Lumina. Where those providers handle protected health information, they do so under written agreements requiring them to safeguard it.

Non-health information — such as technical logs, device type, and usage data — is handled as described in our Privacy Policy at https://www.acaciaclinics.com/privacy-policy.

You have rights to access, request amendment of, and request an accounting of disclosures of your health information. Those rights are described in the Notice of Privacy Practices and are unaffected by these Terms.

10. Availability

We aim to keep Lumina available, but it may be unavailable at times — for maintenance, upgrades, or reasons outside our control. We do not guarantee uninterrupted availability.

If Lumina is unavailable, your care continues normally. Contact the clinic at (650) 521-5211 during clinic hours, or use the emergency resources in Section 4.

We may change, add, or remove features, and may discontinue Lumina entirely. If we discontinue it, we will give patients reasonable notice and continue to maintain your health record as required by law.

11. Intellectual property

Lumina, including its software, design, and Acacia-created educational content, is owned by Acacia or its licensors and is protected by intellectual property law. Certain clinical questionnaires are used under license from their copyright holders. You may use Lumina for your own care. You may not copy, distribute, modify, reverse engineer, or create derivative works from any part of it.

Health information about you remains yours in the sense described in the Notice of Privacy Practices; these intellectual property terms do not limit your rights to your own record.

12. Disclaimers

Except as expressly stated in these Terms, Lumina is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to the platform.

We are not responsible for technical failures, connectivity issues, or device limitations outside of our direct control, such as your internet service provider or your personal mobile device performance.

This disclaimer applies to the Lumina software platform. It does not limit, and is not intended to limit, our obligations to you as your health care provider, or any rights you have as a patient under California law.

13. Limitation of liability

You are responsible for how you use Lumina. If your breach of these Terms, or your intentional misuse of the platform (such as submitting false information, attempting to scrape data, or impersonating another user), results in a legal claim or financial loss against Acacia Clinics, you agree to be responsible for the consequences of your actions.

To the fullest extent permitted by law, Acacia Clinics is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your misuse of the Lumina platform. This includes, but is not limited to, damages arising from data transmission errors, platform downtime, or unauthorized access that occurs despite our implementation of reasonable security measures.

Nothing in this section limits our liability for professional negligence in the provision of health care, for gross negligence, for willful misconduct, or for any other liability that cannot be excluded or limited under California law.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15. Changes to these Terms

We may update these Terms. If we make material changes, we will notify you through Lumina or by the contact information we have on file before the changes take effect. Continued use after the effective date means you accept the updated Terms. The current version and its effective date always appear at the top of this page.

16. Ending your use

You may stop using Lumina at any time and ask us to deactivate your account by contacting Acacia Clinics (650-521-5211 or [email protected]). Deactivating your Lumina account does not delete your medical record — we are required to retain it, and it remains available to you through the same channels as any other patient record.

Sections 9, 11, 12, 13, and 14 survive termination.

17. General

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Notice of Privacy Practices, are the entire agreement between you and Acacia regarding Lumina.
